Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Campsync platform, including all related software, tools, features, and services (collectively, the "Service"), operated by Campsync LLC ("we," "us," or "our"), a Texas limited liability company. By creating an account, subscribing to a plan, or otherwise accessing or using the Service, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.
Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms.
1. Description of Service
Campsync provides a software-as-a-service (SaaS) platform designed for RV parks, campgrounds, and outdoor hospitality businesses. The Service may include, but is not limited to:
- Customer relationship management (CRM) tools
- Marketing automation and communication tools (email, SMS, voice)
- Reputation management and review tools
- Website and funnel building tools
- Reporting and analytics dashboards
- AI-powered automation features
- Mobile applications
- Any additional features, integrations, or add-ons made available by Campsync
The specific features available to you depend on your subscription plan. Campsync reserves the right to modify, add, or discontinue features at any time with reasonable notice.
2. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Promptly notifying Campsync of any unauthorized access or security breach
You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent.
If you suspect unauthorized use of your account, notify us immediately at sean@campsync.io. We are not liable for any loss or damage arising from your failure to comply with this obligation.
3. Subscription Plans and Billing
3.1 Plans and Pricing
Campsync offers multiple subscription tiers with varying features and pricing. Current plan details and pricing are available at campsync.io. Campsync reserves the right to modify pricing with 30 days advance written notice.
3.2 Billing
Subscription fees are billed in advance on a recurring monthly basis. By subscribing, you authorize Campsync to charge your designated payment method on each billing cycle.
3.3 Usage-Based Charges
Certain services (including but not limited to SMS, email sends, AI usage, phone calls, and premium integrations) may incur additional usage-based charges beyond your subscription fee. These charges will be billed monthly in arrears based on actual usage.
3.4 Refunds
All subscription fees are non-refundable except as required by applicable law. No refunds or credits will be issued for partial months of service.
3.5 Failed Payments
If a payment fails, Campsync may retry the charge, suspend access to the Service, or terminate your account after reasonable notice.
4. SMS Messaging Terms and Compliance
4.1 Program Description
This messaging program sends demo confirmations, onboarding updates, service notifications, and customer support messages to customers who have engaged with Campsync LLC through our website at campsync.io or via our chat widget and have explicitly opted in to receive SMS notifications. Opt-in is collected via our website chat widget with dedicated SMS consent disclosure. Messages include demo scheduling confirmations, onboarding reminders, service updates, and customer support communications.
4.2 Cancellation Instructions
You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
4.3 Support Information
If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to sean@campsync.io or call (682) 480-4959 during business hours.
4.4 Carrier Liability
Carriers are not liable for delayed or undelivered messages.
4.5 Message and Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and interaction with Campsync. For questions about your text plan or data plan, contact your wireless provider.
4.6 Supported Carriers
Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
4.7 Age Restriction
You must be 18 years or older to participate in our SMS program.
4.8 Privacy
For privacy-related inquiries, please refer to our Privacy Policy at campsync.io/privacy.
We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations, including but not limited to:
- The CAN-SPAM Act
- The Telephone Consumer Protection Act (TCPA)
- State-specific telemarketing and messaging laws
- All applicable data privacy laws
You agree NOT to:
- Use the Service to send unsolicited communications (spam)
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Access accounts, data, or systems you are not authorized to access
- Resell, sublicense, or redistribute access to the Service without written authorization from Campsync
- Use the Service in any manner that could damage, disable, or impair the platform
- Violate any third-party rights, including intellectual property or privacy rights
- Misrepresent your identity or affiliation with any person or entity
Campsync reserves the right to suspend or terminate your account for any violation of these acceptable use terms without prior notice.
6. Your Data
6.1 Ownership
You retain all ownership rights to the data, content, and materials you upload, create, or store through the Service ("Your Data"). Campsync does not claim ownership of Your Data.
6.2 License to Campsync
By using the Service, you grant Campsync a limited, non-exclusive license to access, process, and display Your Data solely as necessary to provide and improve the Service.
6.3 Your License to Us
By posting or submitting any material (including comments, social media posts, photos, and videos) to us via the Site or other digital venues, you represent that you own the material or have obtained the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, exploit, create derivative works from, distribute, and publicly display such material.
6.4 Data Portability
Upon written request, Campsync will make Your Data available for export in a standard format within 30 days. Following account termination, Campsync will retain Your Data for 30 days before permanent deletion, unless a longer retention period is required by law.
6.5 Data Security
Campsync implements commercially reasonable technical and organizational measures to protect Your Data. However, no system is completely secure, and Campsync cannot guarantee absolute security.
7. Third-Party Services
The Service integrates with and is built upon third-party platforms and services. Campsync is not responsible for the performance, availability, or terms of any third-party service. Your use of third-party integrations may be subject to additional terms and conditions imposed by those providers.
Campsync does not guarantee uninterrupted access to any third-party functionality and will not be liable for any disruption, modification, or discontinuation of third-party services.
Throughout the Site, we may provide links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites or the information, products, or services offered on or through the sites.
8. Intellectual Property
8.1 Campsync IP
The Service, including all software, design, branding, documentation, and proprietary technology, is the exclusive property of Campsync and is protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of or rights to any Campsync intellectual property.
The Site and all materials available on the Site are provided solely for your personal non-commercial use. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site.
8.2 Feedback
If you provide feedback, suggestions, or ideas regarding the Service, Campsync may use them without obligation or compensation to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CAMPSYNC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. CAMPSYNC DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM YOUR USE OF THE SERVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
CAMPSYNC'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO CAMPSYNC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL CAMPSYNC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER CAMPSYNC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify, defend, and hold harmless Campsync LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any data or content you upload, transmit, or store through the Service
- Your infringement of any third-party rights
12. Termination
12.1 By You
You may cancel your subscription at any time through your account settings or by contacting Campsync support. Cancellation takes effect at the end of your current billing period. No refunds will be issued for the remaining portion of a billing cycle.
12.2 By Campsync
Campsync may suspend or terminate your access to the Service at any time, with or without cause, upon written notice. In cases of material breach or violation of acceptable use terms, Campsync may terminate without prior notice.
12.3 Effect of Termination
Upon termination, your right to access and use the Service ceases immediately. You must cease all use of the Site and any content obtained from it. Sections 6.1, 8, 9, 10, 11, and 14 survive termination.
13. Modifications to Terms
We may update these Terms at any time. Material changes will be communicated via email or through the Service with at least 30 days notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The latest version will always be available on our website with the effective date.
14. General Provisions
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas.
14.2 Entire Agreement
These Terms, together with our Privacy Policy and any applicable order forms or service agreements, constitute the entire agreement between you and Campsync regarding the Service.
14.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14.4 Waiver
Failure by Campsync to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
14.5 Assignment
You may not assign or transfer your rights under these Terms without Campsync's prior written consent. Campsync may assign its rights and obligations without restriction.
14.6 Force Majeure
Campsync shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
